The October 14, 2026, Downtown Action Committee meeting in West Palm Beach reviewed two transfer-of-development-rights applications and a formal site plan and zoning-code amendment for a proposed full-service Publix grocery store on Banyan Boulevard. The applicant said it is under contract to purchase part of the site from the city, with the project required to provide a full-service grocery store of more than 40,000 square feet. The committee approved both TDR applications, cases 26-07 and 26-08. It also approved the Publix site plan review with conditions, including a city-reviewed traffic analysis of Banyan Boulevard driveway operations, median modifications to restrict left turns into the site, and do-not-block markings and signage; the Banyan driveway’s right-in-only operation was tied to the traffic analysis. The committee approved several requested variances, approved the active-use variance for the Rosemary Avenue frontage, and denied the shower-facility variance, leaving the shower requirement in place.

The committee recommended approval of code revision case 26-07, but removed the proposed exemption from active-use requirements; the amendment would address open-space requirements for qualifying full-service supermarkets and is subject to further review by the Planning Board and City Commission. Staff said the proposed open-space provisions would allow a payment in lieu or open space at a nearby property. No public procurement award or purchasing decision was identified; the city’s land-sale contract with Publix is part of the development arrangement, not a contract award discussed at this meeting. The committee also received an update on the downtown master plan, including upcoming Planning Board review.
